Legal Notice - Waiver and Release of Liability

The Bucyrus Pickleball Club, hereafter denoted as "TBPC." By engaging in any TBPC activity or event, TBPC is not responsible for any injury, including death (or loss of property) suffered while participating in TBPC activities for any reason whatsoever. TBPC does not own or maintain courts we play on, does not provide, own, or maintain any equipment. TBPC is a social community based non-revenue generating club that is open and free to the public for persons 18 years of age or older. 

 

Waiver and Release of Liability

In consideration of playing with TBPC, you engage in all activities or events at your own risk. You release and covenant not to sue TBPC, it’s player, it’s participants, or agents, from any and all present and future claims resulting from ordinary negligence for loss, damage, or theft of personal property, personal injury, or death, arising as a result of engaging or playing pickleball with TBPC. Additionally, you release and covenant not to sue TBPC, it’s players, it’s participants, or agents, when engaging in any TBPC activities incidental thereto, wherever, or however the same may occur. You (and all players, participants, or agents) hereby voluntarily waive any and all claims resulting from ordinary negligence, both present and future, that may be made by you, your family, your estate, your heirs, or your assignees.

Further, you are aware that TBPC health, fitness, and athletic activities may range from vigorous cardiovascular activity to the strenuous exertion of athletic training. You understand that these and other physical activities at TBPC involve certain risks, including, but not limited to, death, serious neck and spinal injuries resulting in complete or partial paralysis, heart attacks, and injury to bones, joints, or muscles. You are voluntarily participating in TBPC activities and events with knowledge of dangers involved and hereby agree to accept any and all inherent risks of property damage, minor or serious personal injury, or death.

You further agree to indemnify and hold harmless TBPC, it’s players, it’s participants, or agents for any and all claims arising as a result of my engaging in TBPC activities or any activities incidental thereto, wherever, whenever, or however the same occur. I understand that this waiver is intended to be as broad and inclusive as permitted by the laws of Ohio and agree that if any portion is held invalid, the remainder of the waiver will continue in full legal force and effect.

You affirm that you are of legal age and am freely engaging with TBPC. You fully understand that by engaging in any TBPC activities and events, you are giving up legal rights and remedies that you might have now or in the future.
